      to me, Mary Frances,
I have some new information for you about Daniel Oakes. You and I are both descended from Daniel. I have just finished going through the tax lists for 1797-1812. These are posted on my website now. One thing I was trying to confirm was the date of death for Daniel Oakes. All researchers have his death between 1809-1810. This is incorrect. He died between 1792 and 1793. I have just posted my analysis on the Oakes Genforum. I?ll let you read it here: http://www.genforum.genealogy.com/oakes/messages/2369.html.
Here is a listing of Daniel Oaks from the personal property tax list of Pittsylvania County from 1782-1792.
Daniel Oaks in the Personal Property Tax List of Pittsylvania County [image # on microfilm]
From 1782-1786 the tax list lists the peson charged with the tax, the number of males over 21, and then counts the property.
      1782 - 1 thite, 3 horses, 6 cattle [0184]
      1783 - 1 thite, 3 horses, 8 cattle [0210]
      1784 - 1 thite, 3 horses, 8 cattle [0222]
      1785 - 1 thite, 2 horses, 5 cattle [0237]
      1786 - 1 thite, 2 horses, 5 cattle [0237]
Starting in 1787, the tax list names the person charged with the tax, names each person over 21, the number of white males 16-21, and then counts the property.
      1787 - self, 1 horse, 4 cattle [0321]
      1788 - self, 1 horse [0380]
Starting in 1789, the tax list enumerate the number of males over 16, and then counts the property. The person charged with the tax is included in the enumeration.
      1789 - 1 tithe, 1 horse [0406]
      1790 - 1 tithe, 2 horses [0459]
      1791 - 1 tithe, 2 horses [0499]
The 1792 tax list (1792B) does not contain a column for white tithes.
      1792 - 2 horses [0561]
Daniel Oakes is absent from the tax list after 1792. The 1793 list shows his wife, Catherine, with 2 horses. Catherine appears in 1794 with 3 horses, in 1795 with 2 horses, and in 1796 with 2 horses. Catherine remains on the tax list through at least 1812. This researcher has not checked the years after 1812. From this information we can conclude that Catherine Oakes is the widow of Daniel Oakes.
So far, I have been able to confirm 5 children of Daniel and Catherine Oakes: William, Margaret, John, Jesse and Phoebe. Well, that's 5 children for Catherine and 4 for Daniel. Phoebe was born about 1797, four years after her father's death. The register of death shows that Daniel and Catherine are the parents of Margaret Oakes Kirby. The informant for this death record was Joab Oakes, nephew of Margaret. Since Joab is the son of William, this confirms that William is Margaret's brother. The widow, Catherine Oakes, is shown paying the tithes for her sons, John and Jesse, on the 1810 personal property tax list. Finally, Catherine gives consent for her daughter, Phoebe, to marry Wyatt Adkins. William Oaks is the bondsman. So, that is how I worked out these five children. There are probably others which I cannot prove yet.
Published sources give the date of death of Daniel Oakes as circa 1809. The source of this information appears to be a book titlled "Neath the Oaks" compiled by Lonnie L. Okes and published in 1957. Although this researcher has never seen this book, other researchers, citing this source, state that Daniel Oaks is on the 1809 tax list but is listed as "Daniel Oakes Estate" on the 1810 tax list. Which tax list this refers to is not clearly identified. I think I know. The 1810 Land Tax List shows "Daniel Oaks estate" with 228 acres of land. In the years leading up to 1810, Daniel Oakes is shown with 228 acres of land. From this evidence, it was concluded that Daniel Oakes died between 1809 and 1810. This conclusion is incorrect.

Daniel Oakes appears on the personal property tax list of Pittsylvania County from 1782-1792. He is absent from the tax list for all years after 1792. The 1792 personal tax list of Pittsylvania County, Virginia shows Daniel Oakes with 2 horses. In 1793, Daniel is absent but Catherine Oakes, his wife, is on the tax list with two horses. Catherine continues on the tax list through at least 1812. This researcher has not checked the list after this date. Women are not included on these tax lists unless they are heads of household. From this information, we can conclude that Daniel Oakes died between 1792 and 1793.

This conclusion is further supported by the land tax lists of Pittsylvania County. Daniel Oakes is on the 1792 land tax list with 228 acres. In 1793, the land tax list shows Daniel Oakes, dec'd with 228 acres. These records show that Daniel Oakes died between 1792 and 1793 and that his widow, Catherine, was charged with the tax on his property in 1793.

The land tax lists can be very inconsistent on the information provided. Daniel Oakes is shown as deceased in 1793 and in 1810, but not in the intervening years. However, we can safely assume that if Daniel Oaks was deceased in 1793 and 1810, then he is likely deceased in those years between, especially since this conclusion is confirmed by the personal property tax lists.
