      8 May 1717. In obedience to order dated 27 March 1717 we, being sworn by John Chilton, Gent., to lay out the land in dispute between JAMES COURTNELL and SAMUEL EARLE, did on 6th instant meet with Mr. Tho: Newton, surveyor, and proceed to lay off the land of the plaintiff according to the antient reputed bounds thereof. We find that JOHN EARLE, grandfather to the defendant [SAMUEL EARLE], sold 100 acres to LUKE DYNE who was grandfather to the plaintiff [JAMES COURTNELL] by deed 5 March 1685. We had also produced to us by the defendant a pattent for the 100 acres, 25 Oct. 1655. We were also shown a small white oak by the plaintiff standing on the no. branch of the island creek which the plaintiff claims as his beginning tree and was then owned by the defendant to be on the plaintiff's land. It was also proved to us by the oaths of FRANCES SELF and STEPHEN SELF that they being jurors at the last survey of the land did hear ALEXANDER LORD [LLOYD?]declare that SELF and his ancestors were in quiet and peaceable possession of the land above fifty years past without any molestation from the defendant or his ancestors. We accordingly proceeded to lay out the land of the plaintiff up the branch of the island creek..an old marked tree which was proved to us by the oath of JAMES COLEMAN who was a processioner, which EARLE showed to COLEMAN and told him it was the line between him and COURTNELL. We had also
      produced to us by the defendant a patent for 1100 acres, 7 Oct. 1658.
      The defendant also produced a platt of a survey for 1000 acres. Two papers were produced by the plaintiff having relation to the platt and survey. We continued our course further up the ranch to a corner oak reputed to be COURTNELL's corner tree along a line of old marked trees reputed to be COURTNELL's line..down another branch. We had produced by the plaintiff an Order of Court 30 July 1713. We find by the evidence of EDWARD TURNER and his wife SARAH that the defendant told them that he had cut the dam which we find within the aforesaid bounds.
