      To all to whom these presents shall come Greetings, Know ye that I Sarah Barrett of the County of Caswell and State of North Carolina for divers good causes & considerations and more especially for the Love, Good will & affection which I have and bear unto my Grandsons, James Burton & William Barrett Burton & my Grand Daughter Anne Burton hath Given and Granted by these presents I Give and Grant unto the Said James Burton, William Barrett Burton and Anne Burton their Heirs & assigns for ever to Wit, Five Pewter Dishes, Six Plates, and one large Iron pott I give unto James Burton his Heirs and Assigns. I give and grant unto William Barrett Burton one Feather Bed & furniture, Two pewter Dishes and Six Pewter Plates.       In 1781, Capt. Robert Burton commanded a company mentioned in the Pension Application of Dudley Gatewood. James ("Captain James Burton brother of Captain Robert Burton") was mentioned as being the only living person who would remember this service.

      James Burton was enumerated in the 1786 North Carolina census, Caswell Dist.

      Caswell Co. minutes April Court 1790 (from an online transcription):

      These men signed the Oath of Allegiance for Public Officers: Greenwood Payne constable, James Sanders Sheriff, Will Sanders Deputy Sheriff, E. (?)       James is a legatee in his brother William Barret Burton's will in 1805, Caswell Co. Will Bk E, April Court 1805, p.178.

      James Burton was Caswell County's Representative in the North Carolina General Assembly in 1806, 1807, and 1808. He is included in the list at p.550 of "When the past refused to die, a history of Caswell County, 1777-1977," by William S. Powell. From a State Library reference librarian: "The State Archives maintains an index file of information on legislators, and the only information on Burton's card is that he died intestate on December 17, 1838 (with estate settlement in 1839) and that his wife's name was Sarah."

      Misindexed in 1830 Caswell Co. census record (img. 59 of 112 on ancestry.com) as James Barton. Alternate (corrected) name is currently not searchable. James was about 20 years older than Sarah, his wife.

      James died intestate but with a large estate. The inventory was recorded in Caswell Co., Will Bk N, April Court 1839, p. 315, and the division at p. 332. His exact date of death was recorded in the affidavits filed to draw the widow's years' allowance, N.C. Archives, Caswell Co. estate records, 1772-1941.

Petition of William White, James Burton, John Groves [sic], & William Faris to the Assembly: [no date] They were subpoenaed to the Court of Oyer, at Raleigh Jun. 10 "last" for the trial of people charged with "certain" frauds, to give evidence for the State against those charged. They attended the Court. The "Judges" decided at the term the people charged were liable to pay the State's witnesses "on conviction only" [of those charged]. They attended "in some cases" where the people charged were acquitted. But they are "advised" that they are entitled to compensation for their attendance from the State. So they ask for the amount of their "tickets sworn to and filed" with that Court's clerk and which they are ready to produce. [signed] Will White, James Burton, John Groves [sic], & William Faris.
