      This Hutchins Burton's records have been confused with those of a Hutchins Burton who was a son of Capt. Peter Burton of Mecklenburg. They were two different men and DNA has proven them to be genetically independent. This Hutchins Burton (s/o Hutchins and Judith Allen Burton) died in 1828 in Halifax Co. and was not the Rev. War veteran who applied for a pension in Mecklenburg Co. later. Care must be used when researching these men.

      Possible supporting evidence that his wife was named Elizabeth is the fact that there were at least six grandaughters were named either Elizabeth, Betty or Eliza. Elizabeth Burton dau. of William Burton, Elizabeth "Betsy" Faulkner dau. of Lucy Burton Faulkner, Elizabeth "Eliza" Tally dau. of Lucy Burton Faulkner Tally, Elizabeth F. Fitts dau. of Sarah W.       6/24/1793: Allen Burton, of Halifax Co, sold to George Carrington, of Halifax Co, for 130 pds, about 100 acres in Halifax Co, and bounded by Highcho River, Hutchings Burton, Richard Arrington's line which is at present Gregory Baynham's, widow Owens line. This is the same tract of land that said Allen Burton purchased of Rezin Porter, as per deed dated Jun 11, 1780. Said Allen Burton, for the sum aforesaid, which is intended to operate generally, has further sold to George Carrington, his interest in 1 acre on the north side of Highcho River, which acre of land was taken from the lands of Nathan Jones in virtue of a writ of ad quod damnum, issued by an order of the court, and surveyed by the county surveyor, agreeable to an act of Assembly relating to building water grist mills, which said acre is laid off as reported by the jury, and bounded as expressed by the plat.       Nov 1805: Court approval of a payment to Hutchins Burton for appearing as a witness in a suit between Ludwell Overby and Arringtons. The next entry was the approval of the same amount to Elizabeth Burton for appearing as a witness in the same case. This is a hint that Elizabeth could have been the wife of Hutchins Burton.

      Nov 1805: Halifax Pleas 24, page 200 Elizabeth Burton appears in Halifax Court in Nov. 1805 and Pleas 24 pg. 361 in Mar. 1806 as a witness for Ludwell Overby in a suit re: Lucy M. Arrington and Richard Arrington orphans of Richard Arrington . Both Hutchins and Elizabeth were paid $1.06 for two days attendance according to law. Their names were together one line after the other. No indication of relationship is mentioned, but it does seem to suggest that they could have been man and wife. Recorded in Halifax Co, VA Plea Book 24, pages 200 and 361.

      Included among the inventory was 1 Bay Mare and the following negroes:

      1 Negro girl named Patty 125.00
      1 Negro Boy named Charles 100.00

      At a court held for Halifax County the 26th day of March 1828, the within written Inventory & Appraisement of the Estate of Hutchins Burton, decd, was returned to Court & ordered to be recorded.

      2/11/1828: An account of sales of the property of Hutchins Burton, decd, sold the 11th day of Feby 1828, by William Burton, adm.
      The following 5 negroes were purchased:
      Becky was purchased by John H. Burton
      Sally was purchased by by Tandy Fitz
      [These two negroes were in the list that Hutchins Burton Jr deeded to Hutchins Burton III.]
      Handy was purchased by Jonathan Margo
      Patty was purchased by Tandy Fitz
      Charles was purchased by John Wall
      It is interesting to note that in the sale there were two old books purchased. William Nolastname (Burton?) purchased one prayer book for .40 and John H. Burton purchased 1 testament for .10. Could either of these had birth, death and marriage dates written in them?

      1830: William Burton (M40-50) appears as head of a family in Halifax Co, VA census, page 375. Also enumerated are F40-50, M20-30, M15-20, F15-20, M10-15, 2F10-15, M5-10, F<5 plus 5 slaves. John Burton (M20-30) also appears on page 375.

      12/1/1836: The Estate of Hutchins Burton, decd, In act Current with William Burton, Administrator. Balance due the estate was $899.44. Accounting for financial activity of the estate from 2/11/1828 through 12/1/1836.
      Agreeable to an order of the County Court of Halifax, we the undersigned have examined and returned the account current of William Burton, Admr of Hutchins Burton, decd, this 1st December 1836.

      At a Court held for Halifax County the 27th day of November 1837, the within written account current of the Estate of Hutchins Burton, decd, with William Burton, admr, was returned to Court & ordered to ??? one term & at another court held for the said County on the 25th day of December in the year aforesaid there being no exceptions taken to the said account, it was ordered to be recorded.

      1840: E. Burton appears as head of a family in South District in Halifax Co, VA census, page 050. Enumerated are F40-50, F5-10, F<5. Is this widow Elizabeth Burton? Appears to be too young. Allan Burton (M60-70) appears as head of a family in Southern District in Halifax Co, VA census, page 049. Also enumerated are M50-60, M15-20, 2F15-20, F10-15, F5-10. Appears as Allen Halliburton (M50-60) in the 1830 census. [NB: Halliburton is not same name nor family as Burton]

      From the court case filed Nov 1850 in Halifax Co, VA, "...upon the death of said Hutchins Burton his brother William Burton took out letters of administration on the estate of the said Hutchins Burton.....'.". There are many contradictions in the court suit - early on the complainants said that Dianna Burton who married William Faulkner was deceased, as was Sarah Burton who married Tandy Fitz. Later they said they were still alive but Will Book B, p. 239 Trigg Co., KY, 7 March 1839 and 10 June 1839, (published version) shows appraisement and sale of the estate of Dinnah Faulkner, deceased. The buyers at the estate sale included H. B. Faulkner, David Faulkner, Wm. A. Faulkner, and C. J. Faulkner. A few years earlier, 12-30-1833 Will Book A, p. 360, Trigg Co., KY. shows the division of slaves in the estate of William Faulkner. This account lists children Daniel D. Faulkner, Wm. A., Hutchins B.., John D., Charles J., and Jacob. If these records are correct, William Faulkner died by Dec. 1833 and his widow Dianna (Dinnah) died by March 1839. (These records found by Mary Seamster.) [AW note: William Faulkner died in Montgomery Co., TN, by Jan. 1822. Sarah Burton Fitts died in Pittsylvania Co., VA, 21 Jul 1840]

      To the Honorable William Leigh, Judge of the Circuit Superior Court of Law, and Chancery for the County of Halifax: Hardaway Davis and Eliza his wife who before her marriage was Eliza Tally respectfully represent unto your honor, that some 20 years since (about 1830) one Hutchins Burton died intestate , seized of a tract of land in the County of Halifax , containing by estimation 168 acres, leaving a large number of children, and grandchildren to wit: daughter Lucy Burton who first married Faulkner by whom she had two children , Betsey and Charles, and Faulkner then dying she married William Tally, by whom she had five children: William, Bedford, David, John and Eliza, your oratrix; and afterwards said Lucy and her husband both died; that he left also sons David and William Burton, and (John Burton is missing) who are nonresidents of this state, a place of abode unknown; that he also left a daughter Diana Burton who married Faulkner, and by whom she had several children, and who has since died, and the names of her children and their place of residence are also unknown; that he left also a daughter Judith Burton who married Wade, who are nonresidents; that he also left Mary Burton a daughter who married Hutchins Hudson; that he also left a daughter Frances Burton who married William Wilkerson and has since died leaving Julia a daughter who married Thomas Ramsey, and a daughter Caroline who married Richard Griffin who are nonresidents, and Eliza Wilkerson, Richard Wilkerson, Sally Wilkerson, Jane Wilkerson and Bentley Wilkerson; that he also left a daughter Sarah Burton who married Tandy Fitz and has since died leaving three children whose names and residence are also unknown; and Betsy Faulkner daughter of Lucy as your complainants are informed married one Bedford Pool and they with Charles Faulkner her brother are also nonresidents of the commonwealth. Your complainants further show that after the death of said Hutchins Burton his brother William Burton took out letters of administration on the estate of the said Hutchins Burton and proceeded in the administration of the estate , but has fully accounted with your court.....session the land of which Hutchins Burton died, and has rendered no account of the rents and profits but they are informed, and therefore charge has wholly appropriated the same to his own use. Your complainants allege that the only parties entitled to distribution of said Hutchins Burton's estate are your complainants and (proceeds to again name all the same children and grandchildren), that the land aforesaid is now yielding nothing to them, and they are very anxiously desiring that the same may be sold, a division of the proceeds made according to the respective rights of all the parties interested, but in as much as many of them are infants and nonresidents whose names and places of abode are wholly unknown, your complainants are advised that they have no remedy except in Court of Equity for relief. They therefore pray that.....a decree be made for a sale of the land aforesaid and that the proceeds be divided according to the rights of the parties, and that such other and further relief be granted as is consistant with equity and the case requires. May it please the court to grant it.

      5/8/1857: Halifax Co, VA Court- Davis & wife vs Burton et al-Final decree-.....the court doth adjudge, order and decree that Sheriff William W. Breedlove retain in his hands the sum of $48.42.....for the purpose of paying the cost of this suit, and that out of the remainder to pay to David Burton the sum of $35.07.....to John Burton the like sum of $35.07.....to Thomas Wade and Judith his wife the like sum of $35.07.....to Hutchins Hudson and Mary his wife the like sum of $35.07.....to Tandy Fitz and Sarah his wife the like sum of $35.07.....to Diana Faulkner the like sum of $35.07.....to William Burton the like sum of $35.07.....and to the children of Lucy Burton, decd, as follows, to Hardaway Davis and Eliza his wife the sum of $5.00.....to William Tally the like sum of $5.00.....to Bedford Tally the like sum of $5.00.....to David Tally the like sum of $5.00.....to John Tally the like sum of $5.00.....to Charles Faulkner the like sum of $5.00.....to Bedford Pool and Betsey his wife the like sum of $5.00.....and to the children of William Wilkerson and Frances his wife as follows, to Thomas Ramsey and Julia his wife the sum of $5.00.....to Richard Griffin and Caroline his wife the like sum of $5.00.....to Eliza Wilkerson the like sum of $5.00.....to Richard Wilkerson the like sum of $5.00.....to Sally Wilkerson the like sum of $5.00.....to Jane Wilkerson the like sum of $5.00.....and to Bentley Wilkerson the like sum of $5.00.....and the court doth further adjudge, order and decree that Wm W Breedlove for and on behalf of the above named parties do convey the land in the proceedings mentioned to C. F. P. Pool the purchaser thereof by deed with special warranty, and that he do pay the cost of this suit to the further indebted thereto.

      5/20/2010: Per Dorothy Gallion , "In 1998 Jacqueline and I traced the 168 acres of land down to 1986 at Halifax Court House. This was done in an attempt to locate the homeplace/ grave site/cemetery for Hutchins Burton. Family tradition is that Hutchins Burton was buried at route 58 and Hico River. We now know after tracing this land by deeds and tax records "family tradition" is probably correct."
