Henry Campbell Rice was killed when James H. Philpott shot him in the chest. Mr. Philpott's daughter Esterleen, married Henry`s brother George, without her father's permission. Henry acted as surety for the marriage license. James Philpott was very angry with Henry. Henry Rice was later called to testify at a local trial, Mr. Philpott declared him a dishonest man who would not be a truthful witness.
Mr. Philpott and Henry Rice later, had words in a store, which was owned by Henry's brother-in-law Wm. Goggin Reynolds. They took their argument outside. Mr. Reynolds watched from the store window and would testify that Henry had slapped Mr. Philpott on the check at which point Mr. Philpott pulled a hand gun and shot Henry through the chest. James H. Philpott was tried twice, but neither jury convicted him.

One of my Uncles (Henry Campbell Rice) was a "Surety" for the wedding of a younger brother George and a young girl Esterleen Philpott who needed the consent of her father John Philpott to marry. Philpott wouldn't give the consent, so Esterleen signed her father's name to the consent form and Henry when asked if he witnessed the signing of the document said, YES! Later, a very angry Philpott shot and killed Henry. in front of witnesses. Philpott a Mason boasted that as long as there was one Mason on the jury he would not be convicted. Two trials and both hung juries proved him right. This was in 1920. Oh! the young couple moved to NC and were married 69 years before Esterleen passed away.
