      Halifax County, Virginia, Plea Book 1 consists of abstracts of Plea Book 1. It includes court orders for administration and inventory of estates, deed and dower acknowledgements, bills of sale, deeds of gift, leases, powers of attorney, appointments of militia officers, Constitutional officers of the county, lists of the establishment of roads, mills, ferries, ordinaries, etc., as well as petitions for debts due.

Year of the Reign of our Sovereign Lord King George II, and in the year of our Lord Christ, One Thousand Seven Hundred and Fifty Two, a Commission of Peace was produced from the Honorable Robert Dinwiddie, His Majesty?s Lieutenant Governor and Commander in Chief of the Colony and Dominion of Virginia, bearing date at Williamsburg, Virginia, the twenty-eighth day of April in the year of Our Lord, One Thousand Seven Hundred and Fifty Two, and direct to William Byrd,* William Wynne, Peter Fontaine, Jr., James Terry, William Irby, Nathaniel Terry, Robert Wade, Hampton Wade, Andrew Wade, and Sherwood Walton, Gentlemen: - "At this meeting the usual oaths were administered. Nathaniel Terry was sworn sheriff; George Currie was made clerk of the court; Thomas Nash, surveyor; Clement Read (of Lunenburg, and later of Charlotte county), King?s attorney. John Light, Joseph Faris and Abel Lee were appointed constables. Nicholas Hayle, Robert Jones and James Irwin were recommended as justices.

      My wife, Elizabeth, "My tract of land whereon I now live together with my tract of land and Mill on Difficult Creek also I lend my said wife as much of my personal Estate as she shall think proper to take during her life or widowhood and at her death or marriage to be disposed as hereafter mentioned. My wife to have the disposal of all the increase of Sarah while in her possession & the slaves that she shall make choice of to be sold as soon as convenient after her death or marriage to the highest bidder of my sons and daughters & the rest of my personal estate that she shall make choice of to be sold to the highest bidder on twelve months credit the purchaser giving Bond & Security to my Acting Executors and the money arising by such sail (sic) before such Division of my Estate that then the parts of my said Estate that would have fallen to the deceased (were he or she living shall be equally divided amongst the sons and daughters of that deceased), but if my wife should make choice of any of the slaves that I shall bequeath to any of my children or grandchildren in this Will Its not my intent that an of those should be sold that they amediately (sic) at the Expiration of her natural life or widowhood descend to such of my children or grandchildren as they are given to them & their heirs forever."

Difficult Creek beginning at the moth of the branch that crosses the path leading from my house to my said Mill running thence up the said branch on meanders to the head thereof and thence to the nearest of the line of the said Mill Tract. I also bequeath to my son, Edward Wade, one Negro man slave named Dick & one Negro woman named Molly I having made him a Deed of Gift for one Negro girl named Anna all which I give to my said son, Edward Wade his heirs &c., with the restriction that if he the said Edward Wade should die without lawful begotten son or daughter that then the estate to him hereby given shall be sold and the money arising by such sail (sic) to be equally divided among my sons and daughters, or their heirs & assigns forever. I also give to my son, Edward Wade, Thirty head of hogs for the rebuilding of the Mill which is to be done with White Oak Plank and Fraiming (sic) & the charge of building to be paid out of my Estate. I also desire that the Dwelling House should be finished and paid for oout of my Estate and I desire my son, Edward Wade should take possession of the said plantation and land in his giving Bond and security to my Executors for giving my Grandson, Robert Wade six years schooling and for returning houses orchards & plantation in good repair when my Grandson, Robert Wade, sons of my son, Robert Wade, Junior, deceased, shall come to the age of 21 years. I also give unto my Grandson, Robert Wade, Negro boy named Giles &c.
      My neph.: Stephen Jones, Five Pounds Curr: Money, or a horse of value.

      At a Court held for Halifax County the 19th day of April 1770, this last will & Testament of Robert Wade deceased was exhibited in Court by Edward Wade and Memucan Hunt two of the Executors therein appointed and the same being proved by the oaths of the subscribing witnesses was ordered to be recorded (William Wade the Heir At Law Being Present and Acknowledging That he had no objection to such Proof) and William Stokes the other Executor therein also appointed here in court refusing the Executorship, the other Executor took the Oath by law prescribed & having together with the said William Stokes, Thomas Cobbs, James Legrande and William Wade their Securities entered into Bond as the Law directs & acknowledged the same certificate was granted them for obtaining Probate of the said Will in due form.

      It is quite probably that John Frederick's son, Haman, accompanied Captain Wade on various missions, if not the one to New River.
      An 1859 Map of Virginia, shows Goblin Town Creek, just north of the Koger (North)Creek area. The location of the fort, as deduced by Carol Wahl, as well as the placement as shown on the Wilkin's map, appears to be within the mileage limits mentioned in the excerpt from the journal. In Virginia Colonial Soldiers, we find the following items related to that expedition:
      (p. 168)Petition of Robert Wade who last August with his Company of Rangers Killed and Scalped 4 Shawnees in Augusta County. He applied for the rewards but was told there was no money in the treasury. 29 Sept, 1758...
      (p. 239) 26 Oct. 1758 (Calender of Virginia State Papers): John Echols swore that on 12 Aug. 1758 Capt. Robert Wade led a Party of men from Fort Mayo, that on 13 Aug. 1758 Francis New returned to the fort, and that on 18 Aug. Capt. Wade, William Hall, Adam Hermon and two or three others went out and left him in charge... Did George Washington ever visit the site of Mayo Fort? In correspondence from Washington to Governor Dinwiddie we read, Halifax, 10 October 1756. Sir, This day within five miles of the Carolina line, I was proceeding to the southernmost fort in Halifax, I met Major Lewis on his return from the
      Cherokees, with seven men and three women of that nation....they have built three forts here, and one of them, if not more, erected in my opinion in a very out-of-the-way place. This they call Fort Trial.. After his return from the inspection trip, Washington wrote to Lt.-Col. Stephen the following:
      Winchester, 23 October 1756. Sir: Last night I returned from a very long and troublesome jaunt on the Frontiers, as far as Mayo, where affairs seem to be in a dangerous situation...
      From these statements it is clear that Washington did indeed visit the fort built with
      and around John Frederick Miller's property, however brief that visit may have been.
      Washington was also well aware of the plight of those who lived in that section of Virginia. In correspondence concerning the militia, he wrote:
      These men afford no assistance to the unhappy settlers, who are drove from their plantations, either in securing their harvest, or gathering in their corn..
