      Sarah R Farmer's Petition, Halifax Co, VA, 20-Dec-1847
      To the Senate and House of Delegates of Virginia.
      Your petitioner represents that, she is the widow of Pleasant Farmer Dec'd who died in the year 1839 as will more fully appear by reference to the last will & testament of the said decedant, herewith filed and prayed to be taken as a part of this petition, (leaving her with eight small children) It will further appear by reference to the said will that, the deceased husband of your petitioner left to her during her life or widowhood, seven slaves and the trust of land whereof he died seised possessed and whereon he lived, she further represents that, the land aforesaid is too poor to yeald a sufficient support for herself & family, that she has a large family connection in the state of Louisiana, who are able and willing to afford to her any assistance that her circumstances may require, she therefore begs for the passage of a law with such provisions and restrictions, as your wisdom may deem prudent, for the protection of her children, authorizing her to remove the said slaves & their increase to the state of Louisiana (whither she desires to remove with her family) without forfeiting her dower right to the slaves aforesaid acquired under the will of her deceased husband. And as in duty bound she will ever pray.
      Pleasant Farmer's Will
      In the Name of God Amen I Pleasant Farmer of the county of Halifax & state of Virginia, being of sound mind & disposing memory do make this my last will & testament in the manner & form following viz:
      Item, I will & desire that all my just debts be paid & to effect that object I wish the whole of my estate to be kept together for the next year (1839) then the crop of tobacco & surplus perishable estate of every description to be sold & the proceeds applied to that purpose reserving a sufficiency of provision stock & plantation tools for the use & support of my wife & family.
      Item I lend to my beloved wife Sarah B Farmer. All my household & kitchen furniture together with the following slaves viz. Lewis, Levily, Colemon, Harriett, Molly, Cilia & child Charlotte with the increase of the females during her life & widowhood & at her death or marriage to be equally divided among all her children begotten by me viz Elizabeth H Farmer, William Farmer, Lucy Ann Farmer, Sarah R Farmer, Mary Farmer, Samuel D Farmer, Pleasant Farmer & Harriet C Farmer & such other child or children as she may hereafter have by me, to them & their heirs forever.
      Item I lend to my beloved wife Sarah B Farmer the tract of land on which I now live during her life & widowhood & at her death or marriage I will & direct that the said land be sold on a reasonable credit & the money arising from such sale to be equally divided between my sons Hartwell Farmer, Handsome Farmer, & my children Elizabeth H Farmer, William Farmer, Lucy Ann Farmer, Sarah R Farmer, Mary Farmer, Saml D Farmer, Pleasant Farmer, & Harriet C Farmer together with such other child or children as my wife Sarah B Farmer may hereafter have by me to them & their heirs forever & I hereby enjoin it on my executors to see that no more land be cleared than a sufficiency for the use of the family & repairs of the plantation.
      Item I will that at the expiration of the year 1839 or at my death should it take place after that period that the following slaves (viz, Jim, Isaac, Loni, Charlotte, (woman) Dacy, Jesse, Thorntin & Alfred with the increase be advertised & sold on a credit of twelve months & should the provisions made be insufficient to meet my just debts I desire that they be liquidated out of the proceeds of the sale of the above negroes & the balance of the money arising from such to be divided among my children as I shall hereafter direct viz Hartwell Farmer, Handsome Farmer, Elizabeth H Farmer, William Farmer, Lucy Ann Farmer, Sarah R Farmer, Mary Farmer, Samuel D Farmer, Pleasant Farmer & Harriet C Farmer & such other child or children as my wife Sarah B Farmer may hereafter have by me giving my son Pleasant Farmer one hundred dollars the advantage in such division. My son Hartwell Farmer to draw his portion as soon as the money arising from such sale or a sufficiency for this purpose is collected the other children to draw their portions when they arrive at the age of twenty one years.
      Item. It is my will and desire that should either of the above named children die before they arrive at the age of twenty one without a lawful heir that their portions be equally divided among those living it being my meaning & intention that my daughter Nancy Hagood, Ann Musteen nor my sons Hawirton Farmer & Hubbard Farmer nor Harrison nor their heirs have no share or claim in such bequest.
      Item. It is my will that the money arising from the sale of the above named negroes deducting my son Hartwell's portion be put at interest in good land & that my wife Sarah B Farmer be permitted to draw the interest annually for the support & education of her children by me begotten permitting [unreadable] the children to draw their several portions as they arrive at the age of 21 years.
      Item I have given to my daughter Ann Musteen one negro girl Mary one sorrel mare one bed & furniture & one cow & calf & to my daughter Nancy Hagood one bed & furniture one cow & calf one horse & saddle & to my son Harrison Farmer one horse & have given to my son Hubbard Farmer about one hundred & fifty dollars & have also given to my son Howarton Farmer one horse & carry all & fifty dollars in cash. Making about one hundred & fifty dollars & I now will & desire that my sons Hubbard Farmer, Howirton Farmer, & Harrison Farmer & my daughters Nancy Hagood & Ann Musteen nor their heirs have no more of my estate forever.
      Item. And lastly I do hereby appoint my friend Claiborne W Barksdale executor of this my last will & testament hereby revoking all other & former wills by me heretofore made in witness whereof I have hereinto put my hand & affixed my seal this 7th day of January 1839.

      At a court held for Halifax County the 28th day of January 1839. The within writing purporting to be the last will & testament of Pleasant Farmer Dec'd was exhibited in court by Sarah B Farmer the widow of said decedent for probate & thereupon Wm Hagood comes into court & makes himself a party defendant & the motion continued till the next court and at another court held forsaid County the 25 day of June 1839. The said writing was again produced in court by Sarah Farmer the widow of said decedent in order to be proved whereupon William Hagood also appeared and opposed the proof of the said will whereupon divirs witnesses were sworn and examined in consideration where of it is the unanimous opinion of the court that the said Pleasant Farmer was at the time of executing the said will of sound disposing mind & memory and that he was under no undue influence & thereupon the said writing see as proved according to the law by the oaths of the subscribing witnesses thereto it is therefore ordered that the said writing be recorded as and for the last will & testament of the said Pleasant Farmer Dec'd.570
