      FRANCIS POLLARD - Notes of James Maloney

      The following sets out what has been found in the Amelia County Tithable records and on the internet. It is not based on an exhaustive review of the records, but hopefully someone will perform such a review.
      It appears but cannot be stated with certainty that the Francis Pollard who is listed with George Pollard in the Amelia Co. tithable lists in 1737 and 1740 later moved to Lunenburg Co., married Betty Phelps, and died in Bedford Co. in 1771. I believe it is likely that this Francis is the son of George and brother of Joseph and Susannah, but others had speculated that he is the son of Francis or Robert Pollard of King and Queen County.
      George Pollard was granted a patent for 382 acres on Sandy Creek, Amelia Co., on July 9, 1737 (Virginia Land Patent Book 7, p. 373: George Pollard, 393a., Amelia Co., adj. John Radford, John Harris & Joel Meadows, Sandy Creek). He may have been there before the date of the patent as a patent of June 1737 to John Harris states that it adjoins George Pollard; Virginia Lane Patent Book 17, p. 314. "A Plat of the Land Patents of Amelia Co., Virginia,? Amelia County Historical Committee, 1987, shows those two patents; they are in the westernmost portion of present Amelia County. George Pollard's patent is separated from the Appomattox River by only one other patent, and the Appomattox is the boundary between Amelia and Prince Edward counties.
      Francis Pollard appears in the tithables lists on Flatt Creek in Amelia Co. from 1737 - 1751. He is listed after George in the Amelia Co. Tithables lists for 1737 and 1740:

      As he had to be 16 of age to be listed, it can safely be assumed that he was born before 1722. After 1440, Francis and George are listed separately, but in 1744 a Joseph Pollard begins being listed with George.
      In 1749 he brought a successful attachment action against Joseph Hunt in Amelia Co., and he appears for the first time in the Lunenburg tithables lists; in 1749 he and Stephen Clement are listed with Benjamin Clement in Lunenburg and in 1750 he is listed alone on John Phelp?s list in that county. In future records he is often associated with the Clements and Phelps families.
      He is shown in 1751 in Amelia Co. tithables list for the last time, and in 1753 he is shown as ?of Lunenburg Co.? On 28 June 1753, John Phelps, Planter, and Mary his wife of Lunenburg Co., sold to Francis Pollard, Black Smith, of same Co., for £40, 124 acres, Lunenburg Co., on both sides of Otter River, beginning on Troublesome Creek, up creek southeast and back down river (Lunenburg Co. Deed Book, 3, p. 277). The deed recorded immediately before that deed shows Francis Pollard and John Hayes as witnesses to a conveyance by ?John Phelps, Gent., of Cumberland Parish, Lunenburg.? In that same year, John Phelps transferred land to Joseph Hayes who had married his daughter, Sarah/Mary, and based on later conveyances it appears that Francis Pollard married another of his daughters, Betty.
      The fact that Francis Pollard?s father-in-law John Phelps was styled ?Gent.? indicates he was a man of importance, and we find that between 1742 and 1758 he obtained ten patents for land in Brunswick, Goochland, and Lunenburg counties (the last including land on Little Otter River and Troublesome Creek, some of which was apparently transferred to Francis Pollard). Francis Pollard obtained two patents himself, one in 1756 for 340 acres on the south fork of Straitstone Creek in Lunenburg Co. (Virginia Land Patents 33, p. 67) and another for 404 acres on both sides of Strait Stone Creek adjoining the land of Anderson acres in Halifax Co. (Virginia Land Patents 34, p. 212).
      Benjamin Clement (1700-1780) appeared as a tithable on Amelia Co.?s county?s first tax list in 1736. In 1741 he began patenting lands on Staunton River in Lunenburg County in an area that later became Pittsylvania County. He moved there by 20 April 1748 when, described as a ?blacksmith,? he sold 150 acres of his original patent to Edmund Walker [note Robert Gowin indicates that deed shows Francis Pollard as a witness to this deed.}. Lunenburg Co. charged Benjamin on three tithes in 1749 and 1750, with Stephen Clement and Francis Pollard in his household in 1749 and Isaac and Stephen, in 1750. Benjamin held 404 acres on both sides of Straightstone Creek in 1756, the same year that Francis Pollard patented 340 acres on the south fork of Straitstone Creek in Lunenburg (see below). Francis maintained a relationship with the Clement family for some years. He was described as a blacksmith in the 1753 deed from John Phelps, and it appears to me likely that he moved to Lunenburg with Benjamin Clement, another blacksmith, in 1749, and decided to stay. [Robert Gowin indictated that tithable list of Matthew Talbor recorded Francis Pollard living in household of Benjamin Clements., and that in 1750 John Phelps in Lunenburg/Bedfolrd Co. recolrds Francis and records Benjamin with sons Stephen and Iassc.] On Sept. 20, 1758, Francis Pollard and Betsy, his wife, of Bedford Co., Virginia, conveyed to Stephen Clements, a son of Benjamin, the 404 acres in Halifax Co. which Francis had patented earlier in the year (Halifax Co. Deed Book 1, p. 495; Stephen conveyed much of this land to Pleasant Thurman of Chesterfield in 1781). Also, in 1759, another son, Benjamin Clements, patented 266 acres on both sides of a branch of Strait Stone Creek, adjoining Francis Pollard (Virginia Land Patents 34, p. 259). In 1761, Francis Pollard was a witness to two deeds between Stephen Clement ?of Bedford? and John Absolom/Abston for property in Halifax Co.
      As indicated above, by 1753 Francis was ?of Bedford.? If it likely that his property was in that part of Lunenburg that formed Bedford Co. in that year. His name appears in the Bedford Co. Order Books from 1753 - 1760; a member of grand juries, bounty for wolf?s heads, and assignment to a crew for ?on the road from Fish dam on Otter River to the Dirt Bridge at the upper end of Long Mountain.? I have not seen order book information after 1760. Francis and Betty Pollard resided in Bedford until Francis death in 1771 when he was probably in his early fifties. His will dated April 3, 1771 was recorded July 23, 1771, and his executors were his wife, Betty, and John Phelps, Jr., (his brother-in-law) and James Calloway ( Bedford Co., Will Book 1, p 131) Transcribed and posted on the Pollard Gen Forum 10Jan 04 by Ruth Burket:

      The estate was not divided until 1780, and at that time five of his chlidren were still minors. In February of that Judith, Sarah, Jane, Betty, and Francis chose John Otey as guardian. On July 25, 1780, the division of his estate was recorded in Bedford Co. Will Book 1, p. 370:

      Pursuant to an Order of Bedford Court the following division is made of The
      Estate of Francis Pollard Decd Viz

      425 Acres of Land whereon the said decd. formerly Lived is Equally
      divided by a line Begining [sic] at a Corner white oak in Pollards old line
      and Runing [sic] to a Beach on Middle Branch. Thence down the Branch as it
      meanders to the lower line allotting that part where the Old Plantation is
      to Thomas Pollard he paying to John Phelps Guardian to John Pollard and for
      his use one Thousand pounds on the first day of July next also £2481..3.7
      in the hands of James Callaway Exor &C for the Decd.
      To John Pollard is allotted the other part of the above Tract of Land

      Betty Phelps Pollard was required to give"counter sec[urity]" as admistrator, Order Book 6, p 187, 207, 248 (dates not specified), and she was still alive when she was in court in conjunction with her husband?s estate in August 1779. It is likely she died shortly after that and that her death triggered the division of Francis? estate. Francis?s brother Joseph died in Amelia Co. in 1789, and his estate was not finally settled until 1832 after the death of his widow, Leah, in late 1828.
      The 1780 settlement indicates Francis and Betty Pollard had the following children, probably all of whom were under twenty-one years of age at the time of their father?s death: Thomas Pollard, John Pollard, Elizabeth, who married Harris Toney, Mary, who married William Melton, Susanna, who married John Loaden, Judith, Sarah, Jane, Betty, and Francis.
      All of the marriage records but one found for the children are in Bedford Co. Thomas Pollard married Chizia 'Keziah' Hunt on Aug. 1, 1778. John Pollard married Catherine Nichols on Jan. 9, 1787, Judith married Joseph Going Sept. 30, 1780, shortly after the settlement, and she and her husband moved to Missouri. Jane married William Mason on Mar 10, 1785. Betty married Flayle Payne in Oct. 16, 1790, in Franklin Co. Francis [sic] called Frankey married Zachariah Kennett Nov. 1, 1798.

In 1741 Benjamin began patenting lands on Staunton River in Lunenburg County in an area that later became Pittsylvania County. His first acquisition was 129 acres by patent dated 20 August 1741. He moved there by 20 April 1748 when, described as a ?blacksmith,? he sold 150 acres of his original patent to Edmund Walker.       Benjamin held 404 acres on both sides of Straightstone Creek in 1756 and a nearby 266 acres in 1759, both tracts of which Benjamin and Susanna sold in May 1760. By 1767 he was charged with five tithes, including James Clement, and 529 acres in Pittsylvania County.

Ano ye Domina One thousand seven hundred fifty & Eight Francis Pollard of the County of Bedford and Bety his Wife of the one Part and Stephen Clement of the County of Halilifax of the other part Witnesseth that the said Francis Pollard and Bety his Wife for and in Consideration of the Sum of foreteen Pounds Curent Money by the said Stephen Clement to the said Francis Pollard in hand paid at and before the in sealing and delivery of these Presents the Recet whereof he the said Francis Pollard doth hereby Acknowledge and the said Stephen Clement his Heirs and Assigns thereof and there from doth herby for ever acquit Eonarate and Dist charge hath granted Bargained and Sould and by these Presents doth grant Bargain sell Elienfe off and Confirm unto the said Stephen Clement his heirs and Assigns all that Tract or parcell of land Containing by Estamation fore hundred and fore Acres be the same more or less Situate lying and being in the County of Halifax and is bounded as followeth Beginning at George Willcox Corner maple in the lowgrounds of the said Creek thence New line South forty degrees East twenty seven Poles to Pointers in Andersons line thence on his line South Sixty five degrees two Hundred and twenty Poles to a pine thence New lines North Three Degrees West One Hundred and Seventy Six Poles Crossing the Creek to Pointers in George Willcox line and thence on George Willcox South forty degrees East one hundred and fifty two poles Crossing the Creek to the first Station, Together with with all and Singular the Houses Buldings fences Orchards woods Underwoods Ways Waters Meadows Feedings and all other Benifits and Advantages whatsoever to the said land Belonging or in any wise Apertaining and all the Estate Rite Title intrest use Property Reversion Clame or demand of the said Francis Pollard and Bety his Wife his wife of in or to the same or any Part or Parcell thereof To have and To hold the said fore hundred and fore acres Land be the same more or less with all and every its Appurtanance to the said Stephen Clement his heirs and Assigns forever to the only Proper use and Behoof of him the said Stephen Clement his heirs and Assigns for ever and to no other use Intent or Purpose Whatsoever and the said Francis Pollard and Bety his Wife for themselves and there heirs do Covanant and agree to and with the said Stephen Clement that the said Francis Pollard and Bety his Wife shall and will warrant and forever defend the said land and premises hereby granted unto the said Stephen Clement his heirs against the Clame or Clames of all and every Person or Persons Whatsoever and the said Stephen Clement his heirs and Assigns shall and may from time to time and at all times forever here after freely peaceably and Quietly Enter into and upon have hold use Occupy Possess and injoy the said land and Primices hereby granted without the Lawfull Lett Suit Trouble Denial Molestation or Disturbance of them the said Francis Pollard and Bety his Wife their or Either of theire Heirs or assigns or any other Person or Persons whatsoever and also that the said Francis Pollard and Bety his Wife shall and will at any time hereafter at the Request and Proper Cost and Charge in the law of him the said Stephen Clement his heirs and assigns Make and Excute or Cause to be made and Executed such further or other lawfull and Reasonable acts and conveyances and Assurances whatsoever as shall be adjudged Necessary for the Quiet Enjoyment of the above mentioned Granted Land and Premises to the said Stephen Clement his heirs and Assigns forever In Witness whereof the said Francis Pollard and Bety his Wife have hereunto sett there hand and seals the day and year first above written.
