Ordered JOSEPH POLLARD and Phillip Thomas be discharged, and John Morris, Shadrack Turner and Thomas Witworth Jr. Enter into recognizance of £20 each and their several servants in the sum of £10 each for their good behavior for the space of one year. Thomas Witworth, Thomas Witworth, Jr., and John Shorter entered into recognizance, ad did Shadrack Turner, William Eackols and John Harris.       In the Name of God, Amen. I, Joseph Pollard of Amelia County being weak in Body but of a sound and perfect memory do make and ordain this my last Will and Testament, principally and first of all Item I lend to my beloved wife Leah Pollard all of my whole Estate of every kind and denomination whatsoever during her Natural Life Item I give to my loving sons by name five pounds each to be received out of my Estate Zachariah Pollard, Thomas Pollard, Hezekiah Pollard, Moses Pollard, John Pollard and Robert Pollard to them and their heirs forever. Item I give to my daughter Mary Pollard one Negro Girl slave Nann to she and her Heirs for ever. Item I give to my son Robert Pollard my land whereon I now live containing one hundred and forty three acres be the same more or less and if he should Depart this Life before he comes to the age of Twenty one years then the next youngest son to take the said Land and if he should depart this life in like manner then to the next youngest and so to continue on. Item I give to my daughter Hannah James one shilling and three pence.       Pursuant to the annexed order of the Worshipfull Court of Amelia Co., they subscriber as master commisfioner of said County has examined, stated and settled the accounts of Edward Green as the administrator with the will annexed of Joseph Pollard deceased a true statement of which is hereto annexed by which it will be seen that said administrator is indebted to his testators estate a ballance of four thousand four hundred and fifty six dollars and seventy six cents on the first day of January 1831 which balance will be subject to the payment of the specific legacies of five pounds each to the testators following sons to wit Zach: Pollard, Thomas Pollard, Hezehial Pollard, Moses Pollard, John Pollard and Robert Pollard (unlefs some of them died without heirs). It will be seen that I have not charged the administrator with interest on said balance for the last year as he was aware the administrator was ready to pay over to the distributees their respective proportions of the same, so soon as the amount could be ascertained and I am informed he did pay over to some of the legatess good part of their distributable shares when called on, the administrator therefore never could have been justified in lending out the money, when he was subject to be called on for it every day, it must also be recollected that the distributees were dispersed in various parts of the country, at a considerable distance from this county. Given under my hand this 20th day of March 1832.

      This account with report of Commisfioner Booker annexed was exhibited into court and ordered to remain sixty days. And at another court held for said County the 27th September following, no exceptions having been filed to the said account and report, was ordered to be recorded.

      hired out the negroes; that the negroes cannot ^ be divided in kind among those entitled; that James Deaton in right of his wife Betty Deaton, formerly Betty Pollard, xxxxxxxxx Pollard, Moses Pollard, Lucy Ann Pollard only daughter of John Pollard dec'd son of said Joseph Pollard dec'd and entitled to full share of said estate & are absent from this Commonwealth; that
      Joseph Pollard son of George Pollard dec'd who was a son of said Joseph Polland dec'd also absent from this sate and entitled to 1/? of said cpxxxx that a certain Nath'l Harrison, as your complts are informed has purchased the interest of the aforesaid Thos. Pollard and taken a conveyance fro the same, which is of record in this court; To the end therefore and in as much as your complts are without remedy but in a court of Equity where such matter are properly cognizable, the pray your worships to order and decree the sale of said negroes, and distribution
      of said estate: and that the said Edward Green Ad'r as aforesaid James Deaton, in right of his wife Betty, Wm. Pollard, Moses Pollard, Lucy Ann Pollard by her grd'n ad litem to be appointed by this court, and Joseph Pollard be made defendants to this bill and answer the aligations thereof and that Robert Pollard be apappointed the gadn ad litem of Lucy Ann Pollard,infant daughter of John Pollard dec'd to defend her interest in this suit, and grant such other and further relief as your worships may thing fit and proper.
