      12. SARAH4 GHOLSTON (ANTHONY3, ANTHONY2 GHOLSON, JOHN1) was born Abt. 1745 in Spotsylvania County, Virginia26, and died 11 October 1834 in Mercer County, Kentucky. She married CHARLES POWELL Abt. 1765 in Spotsylvania County, Virginia27, son of CHARLES POWELL. He was born Unknown, and died Unknown.

      Notes for SARAH GHOLSTON:
In 1807, Sarah Gholston Powell filed a suit in the Mercer County Circuit Court in Chancery against Charles Powell. She said that about 40 years earlier "she unfortunately intermarried with a certain Charles Powell," bringing to the marriage 100 acres of land in Spottsylvania County and receiving on the death of her father personal estate and a female slave. She said Charles brought to the marriage a horse and wearing apparel and had received nothing in the way of inheritance. She said that after years of treating her with "customary tenderness and affection" Charles had for four years treated her with cruelty and indignity. She said she had every reason to believe and did believe that "he has long lived in a state of fornication with negroess slaves, that he has indulged himself in her presence with every dalliance short of fornication with her female slaves for more than eight months now." She alleged also that Charles had beaten her with his fists and with sticks and on one occasion had attempted to smother her to death. Recently, she said, Charles had "bartered away a very valuable negro man at a vast under value for the purpose of possessing a negro girl as your oratrix readily believes for the use of prostitution." Sarah said Charles had driven her from their home. She asked the court to enjoin him from selling property and from leaving the state and taking the slaves with him. The complaint in S. Powell v. C. Powell is found in Mercer County, Kentucky Records, Judgment Box P No. 7.

Later in 1807, there was filed in the Mercer County Deed Book an agreement between Charles and Sarah in which Charles conveyed to Jeremiah Briscoe five slaves, half of his cattle, sheep and hogs, all of the kitchen furniture, 20 barrels of Indian corn, a roan mare, two yearling colts and a feather bed. In exchange, Briscoe was to pay Sarah the annual interest on $1,000 as alimony. On Sarah's death, the remainder was to be distributed according to her will

      Notes for CHARLES POWELL:
Inventory of the estate of Charles Powell the Elder in Stafford County, Virginia Will Book for 1729-1747. The inventory, made in 1744, showed Charles owned nine head of cattle, a mare and a colt, a horse, bridle and saddle, two bridles, a parcel of hogs, an old bed, bedstead and other furniture, two beds, bedsteads and other furniture, a cupboard and a chest, a parcel of books, two bottles and some iron, a glass cutter, a parcel of lumber, case knives and forks, grinding wheel, a parcel of pewter, a parcel of lumber, binder hooks and a stamp, two small bags of leather, two old chests, three pots and pothooks, a frying pan, a kettle, an iron chain, a pound of shot, two bags, a wallet, a drawing knife and a sugar box. The total value of the property was 37 pounds 8 shillings 3 pence. The inventory was admitted to record 2 February 1774. The appraisers amended the report 16 May 1746 to include hogs and a small parcel of lumber. --The Three Sisters Website 19 December 1997.

Charles Powell was appointed to the First Artillery Continental Troops 3 January 1777 for a three-year term. He was at Valley Forge 3 June 1778, Camp White Plains 8 August 1778, sick at Camp Fredericksburg 1 October 1778, promoted to sergeant 1 October 1778 and pay rate increased from $9 a month to $10, at Camp Pluckamin 21 December 1778, at Middle Brook 3 June 1779, at Camp Smith's Clove 4 July 1779 and at New Windsor 3 August 1779 and was discharged 10 January 1780.
